Actor Olivier Martinez was granted a temporary restraining order to keep ex-wife Halle Berry away from him and their son, Maceo.
The Unfaithful actor alleges that Berry abused their son on Sept. 26.
Berry’s attorney claims the filing for a restraining order is “entirely meritless.”
Olivier Martinez has been granted a temporary restraining order against Halle Berry, after he accused his ex of physically abusing their 12-year-old son, Maceo.
A Los Angeles County judge ruled Thursday that that actress must stay away from father and son, according to PEOPLE.
Court records viewed by the outlet showed that the judge also made temporary changes to the couple’s visitation agreement, while denying the French actor’s request that Berry’s sobriety be monitored on grounds that “insufficient information” had been provided.
For now, visitation will be limited to Mondays and Tuesdays between 10 a.m. and 8 p.m., and Saturdays and Sundays from 10 a.m. to 8 p.m.
The next hearing on the matter is scheduled for Oct. 16.

In his petition for the TRO, Martinez alleged that Berry had “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.” Martinez claimed that he had suffered “emotional and mental distress due to physical abuse” of their son, who turns 13 on Oct. 5.
The actor alleged in his request for a restraining order that he was making the move after an incident that happened on Sept. 26. He said he received a “frantic call” from his son asking to be picked up from Berry’s house and that, when he did so, Berry’s fiancé Van Hunt, who had been present at the time of the incident, had “a shocked look on his face.”

Martinez alleged that Berry had “grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?’”
The Oscar-winning actress and Martinez, the star of Unfaithful and Taking Lives, were married in 2013 after dating since 2010. They split in 2015, although the divorce wasn’t finalized until 2023.
Martinez is also now seeking full custody of Maceo.

Berry’s attorney Marina Beck had dismissed Martinez’s allegations in a statement to Entertainment Weekly. “To say this filing is entirely meritless and deliberately misleading would be an understatement.”
She accused Martinez of having “violated court orders and interfered with therapeutic and educational interventions” that involve Maceo, as well as being “erratic” and “possessive.”
“Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs,” Beck said.
Berry is also the mother of 18-year-old daughter Nahla, whom she shares with ex Gabriel Aubry.
