Halle Berry’s ex Olivier Martinez accuses her of child abuse, seeks restraining order

French actor Olivier Martinez has taken serious legal action against his ex, Halle Berry, accusing her of abusing their son and filing a petition for a temporary restraining order.

According to the petition for a domestic violence restraining order obtained by Entertainment Weekly, Martinez accused the Catwoman star of having “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.” Martinez alleges he also suffered “emotional and mental distress due to physical abuse” of Maceo, who is 12.

That petition was filed in the Superior Court of California on Thursday. In an ex parte notice, or, notice to the opposing party of an emergency court order request, which Martinez also filed in Superior Court on Thursday, the actor notes he did not personally give notice to Berry about the filings, checking a box that reads, “I was afraid that the violence would reoccur when I gave notice that I was asking for these orders.”

Martinez claims in the TRO request that the alleged incident took place on Sept. 26, but he contends that “there have been other instances of abuse over the course of the last few years,” consisting of both “verbal and emotional abuse from Petitioner to me.”

In that same request, Martinez also alleges that Berry made “racially charged statements” about him during a child support dispute. Martinez claims that Berry referred to him as a “white bitch trying to rob a Black woman,” then asking their son, “How do you feel about that as a Black man?”

Entertainment Weekly has reached out to representatives for Berry and Martinez for comment.

Berry and Martinez were married in 2013, separated in 2015, and their divorce was finalized in 2016. They share Maceo, and Berry also shares 18-year-old Nahla with ex Gabriel Aubry.
